THE EXECUTIVE ORDER ON AI WAS JUST THE OPENING ACT

The President’s Executive Order on AI, issued November 1st, put forth wide themes on how government agencies should use AI.  Strengthening AI Governance, Advancing Responsible AI Innovation, and Managing AI Risk were the three main pillars of the order.  Even as agencies and contractors sift through this document, work is already underway that will impact both federal agencies and their industry partners.  OMB states that it will help shape procurement procedures for AI.  This will include developing a system for ensuring federal contracts align with the AI Executive Order.  Further, the General Services Administration recently announced that it plans to play a large role in how the AI Executive Order is implemented on the procurement front.  Contractors may want to watch that work closely as OMB often relies on agencies such as GSA to field the team of workers necessary to implement a policy.  In short, nearly all federal technology contracts will include new AI-related requirements.  Contractors with innovative AI solutions should not expect government AI policy makers to know about them, or how they work. It is essential that industry engage OMB and GSA now to ensure that industry-developed technologies being offered and created can work within the framework of the EO, as well as whatever additional policies are developed from it.  Comments on OMB’s announcement are due December 5th.  There is a short time to ensure that industry voices are heard.  Companies with AI solutions should not only watch this process but be active participants in it.  Plan now to submit comments to OMB and sit down with GSA leadership.  Government action may be well-intended, but industry should not believe that the officials here have the same level of experience or expertise with AI that they do.
