BUYING TRENDS, RULE CHANGES, AND PENDING LEGISLATION: THE WEEK, IN GOVERNMENT PROCUREMENT

The government market continues to evolve as new buying trends, rules, and legislation continue to come on the scene.  Here are three things being discussed right now that could impact your federal business.

1.  IDIQ’s Dominate Professional Service Spending:  Data shared by GSA last week shows that much more than half of professional service acquisitions are conducted via Indefinite Delivery Indefinite Quantity (IDIQ) contracts.  The single largest services contract is GSA’s OASIS contract.  While the top 10 contractors control 20% of professional services spending, over 700 additional companies receive business constituting 80% of the federal professional services market. Over 2,000 professional service businesses recorded sales overall. 

2.  Greenhouse Gas Disclosure Rules Could Be On Hold:  The Securities and Exchange Commission issued a stay of its pending final rule requiring publicly traded companies to disclose their greenhouse gas emissions and make related environmental disclosures.  While not directly tied to FAR rulemaking, the impact of the stay could result in the FAR Council tabling the issuance of its related final rule for contractors.  This is especially true since the SEC was “encouraged” to make their decision based on the probability that they would have faced a temporary injunction until a court has time to resolve the legality of the rulemaking.

3.  Multiple New Bills Are Under Consideration in Congress:  First up is the FY’25 Defense Authorization Act, a bill that is considered “must pass” but which at least one Member of Congress has said will be “tough” this year. Contractors should definitely watch that space.  In addition, new measures to reform IT acquisition and reduce the need for a college education among government contractor employees are also being considered.  While these measures face an uncertain fate, contractors may want to weigh in with their views as appropriate.
