GETTING A CONTRACT MODIFICATION? DON’T SIGN AWAY YOUR RIGHTS
As GSA is preparing a mass modification package for multiple schedules, a caution light should flip on for Schedule contractors. The modification package will reportedly be substantial and there will likely be pressure put on contractors to execute it quickly. Remember, though, that there are no points for being the first company to return a mod. Read the package and your own contract carefully before you sign. Make sure that special terms and conditions you currently have in your contract won’t be erased by executing the mod. If they will be, amend the modification package to keep your hard-won terms intact. Also, ensure that all people in your company who need to know about different provisions know and understand their responsibilities. This can sometimes extend to commercial sector people, so don’t assume that briefing the federal team is all that’s required. Getting a unilateral modification? If it’s a problem for your company, say so. Companies don’t always have to surrender important positions, even when the government sends a unilateral change. You don’t have to be fast, but you do have to be thorough.
