JUST IN TIME FOR ADMINISTRATION’S END, PROPOSED GUIDANCE ON FED-TO-CONTRACTOR HIRING

With a number of Administration officials already leaving government, the Office of Government Ethics has issued a proposed rule providing guidance to feds, and by extension those who might hire them, to clarify the role of social media and other evolving technologies so that all concerned parties have proper guidance on acceptable activities.  The proposed rule provides a new definition of a “prospective employer,” stating that “online resume distribution services are treated like employment search firms for purposes of determining when an employee has begun seeking employment.”  As such, posting a resume, or finding one there, would not be considered an unsolicited communication.  Only when actual discussions are contemplated would recusal actions have to be taken, if applicable.  Also clarified are situations when a federal employee is seeking employment with a firm that has no current direct business with that person’s agency.  Contractors are likely already looking at possible retirees, whether tied to the Administration or not, as this may seem like a natural time for some to leave government service.  Former feds can make a great addition to your team.  Just be sure to follow the rules.
